South African opposition politician Julius Malema was sentenced to five years in prison on April 16 for firing a rifle in the air at an Economic Freedom Fighters (EFF) rally in 2018.

Magistrate Twanet Olivier handed down a five-year sentence for unlawful possession of a firearm and a two-year sentence for unlawful possession of ammunition in the case stemming from the incident at a stadium in the Eastern Cape province.

The 45-year-old leader of South Africa's fourth-largest parliamentary party had pleaded not guilty, arguing the gun was a toy. The court disagreed.

What Happens Next

Within minutes of the sentence being read out in the court in KuGompo City (formerly East London), Malema's lawyers applied for leave to appeal — a request that was granted. Malema is not currently in prison and has been released on bail while the appeal process, which could take years, plays out.

The sentence has sparked significant legal and political debate in South Africa, with some arguing the punishment is disproportionate while others say it reinforces the rule of law.

The EFF has called the sentencing "politically motivated" and vowed to continue its campaign for economic transformation regardless of the outcome.
